Position of ENERGO-PRO Networks on CPC's allegations of abuse of dominant position
At present, ENERGO-PRO Grids has not been officially notified of the CPC's allegation of violation under Article 21 of the CPC, expressing abuse of a dominant position, nor has it received a CPC determination to press charges. Once the experts have familiarized themselves with the specific statements of the CPC, the company will present its objections within the stipulated time limit.
The company has not violated the Competition Protection Act. In its actions ENERGO-PRO Networks has always followed the requirements of the Bulgarian legislation, which regulates the rules for connection of electricity producers to the electricity distribution network.
The photovoltaic power plant “Orlova Mogila” was put under voltage as early as 2012 in compliance with the regulatory requirements, producing and selling electricity for years.
The case has already been considered once by the CPC, then in 2014. The Supreme Administrative Court annulled the decision of the CPC to establish an infringement as unlawful.
